The Attorney General has filed a lawsuit against JA Plant Pool and Mr. Siaw Agyepong concerning an alleged overpayment under the DRIP machines agreement.

According to court documents, the contract listed a total value of GHS 178,704,739.50. The Attorney General alleges that the sum of the itemized figures in the agreement amounts to GHS 176,704,739.50, resulting in a difference of GHS 2,000,000.

The writ states that the higher amount was paid to the company and seeks the recovery of the alleged excess payment, along with interest at the prevailing commercial rate.

The Attorney General’s office also noted that this matter is separate from a reported tax issue involving the same company and the DRIP machines. Officials said the tax matter will be handled separately following confirmation from the Ghana Revenue Authority.

Key points from the lawsuit:

  • Payment details: The state alleges that payment schedules were based on the higher figure, leading to the full amount being disbursed through the Ministry of Finance and OmniBSIC Bank.
  • Alleged discrepancy: The writ claims the excess amount was paid without corresponding equipment, services, or other consideration from the defendants.
  • Claims made: The suit includes allegations of unjust enrichment and states that demands for a refund were made but not met.
  • Relief sought: The Attorney General is asking the court to order JA Plant Pool and Mr. Siaw Agyepong to jointly and severally refund the alleged $2 million overpayment, plus interest, and any further relief the court considers appropriate.

The case is currently before the court, and the defendants are presumed innocent until proven otherwise.
